The Rulebook, is an open legal infrastructure to automate the generation of governance, contracts and agreements for data transfers and data portability between the person, the data intermediary, the organizations holding the data and the organizations receiving the data.
The GDPR and the more recent DAta Governance Act Proposal, introduced 'data intermediaries' mobilized to help individuals manage their data. This legislation also set the governance framework for data portability. This legislation also set the governance framework for data portability. In order to produce a vast European data portability infrastructure there needs to be a more precise legal framework with a contractual framework taking into account industry-speciﬁc regulations, ethics charters, codes of conducts and determining each party’s responsibilities and liabilities during data transfers. This legal model needs to be backed by a strong legal infrastructure to be able to automate the genera- tion, signature, auditability and traceability of these contracts and governance frameworks. This legal infrastructure should be based on the collective work and contribution of multiple parties that can also beneﬁt from it.
The Rulebook, will provide an open-source API to be used by data intermediaries to automatically generate appropriate contracts for hu- man-centric data transfers and data portability based on consent. This is all made possible via machine readable, open contractual clauses described as objects, published on a common open git, using W3C standards (data privacy and controls vocabulary). A contract ledger to no- tarize the data transfer contracts on the blockchain will also be built.
Based on the project team’s involvement in many data portability projects, they have come to the conclusion that a key part of the data por- tability infrastructure, to be used by all data intermediaries, must be this common Rulebook. This Rulebook governance technology enables automation and optimal compliance, trust, human-centricity, transparency and auditability, and overall generates value for the data sharing ecosystem.
Every single data portability project run by a data intermediary starts with the legal and governance model between the involved parties. The Rulebook will allow us to automate that model and implement it for a wide user-centric adoption. The DAPSI Rulebook project will collaborate with the Skills Alliance of aNG where more than 40 organizations work together to create a pan-european skills data portability network. Major public actors participate in the Skills Alliance: universities, employers, platforms, training organizations from 6 countries (France, Finland, Netherlands, Sweden, Germany, Danemark) that are all committed to building a common human-centric European skills data space based on consent and portability, through local projects like this one in the North of France or this one in Finland.
The Rulebook will be created and tested with and for them through the DAPSI project before being then scaled and implemented in other sectors like mobility, where aNewGovernance has a strong presence as well.
